1. Acceptance of Terms

By accessing and using 360Crafter ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Service Description

360Crafter is an online 360° virtual tour builder that allows users to create, configure, and manage virtual tours using their own content including panoramas, images, videos, and PDFs. 360Crafter is a brand of 360Creators.

3. Parties and Definitions

3.1 Who We Are

• "We," "Us," "Our," "360Creators," or "360Crafter" refers to 360Creators, the company providing the 360Crafter service located at Paxtonstraat 3-N Unit E1388, 8013RP, Zwolle, The Netherlands
• "Service" refers to the 360Crafter virtual tour builder platform
• "Platform" refers to the 360Crafter application and associated services

3.2 Who You Are

• "You," "Your," "User," or "Customer" refers to any individual or entity using the 360Crafter service
• "Account" refers to your registered user account on the platform
• "Content" refers to any panoramas, images, videos, PDFs, or other materials you upload or create using the service

4. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

5. User Accounts and Registration

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

6. Content Ownership and Rights

6.1 Your Content

• You retain full ownership and control over all content you upload, create, or configure using the Service
• You have complete rights to export, sell, or use your tours commercially
• You are solely responsible for ensuring you have the necessary rights to use any content you upload

6.2 Our Use of Your Content

• We do not claim ownership of your content
• We will not use your content for marketing or promotional purposes without your explicit written permission
• You can delete your content completely from our system at any time

7. Data and Privacy

7.1 Content Storage

• Your content is stored according to your chosen storage option:
  • Your own S3 storage: Content remains on your own storage infrastructure
  • Our subscription storage: Content is stored on 360Crafter's servers
• We implement industry-standard security measures to protect your data stored on our servers
• When using your own S3 storage, you are responsible for the security and availability of your storage infrastructure

7.2 API Keys and Credentials

• If you provide S3 storage API keys, these are currently stored unencrypted
• We are working to implement encryption for all stored credentials
• In the event of a security breach affecting your credentials, we will notify you immediately and take all reasonable steps to improve security

7.3 Analytics (Optional)

• We may offer optional self-hosted analytics to track user behavior within 360Crafter
• You will be notified before any analytics tracking begins
• Analytics are completely optional and can be disabled at any time
• We will provide clear information about what data is collected and how it's used

8. Pricing and Payment

8.1 One-Time Purchase

• Users who provide their own S3 storage can purchase a one-time license
• This license grants access to the Service for as long as the Service exists

8.2 Subscription Model

• Users who choose our storage solution will be charged on a subscription basis
• Subscription terms and pricing will be clearly communicated before purchase
• You may cancel your subscription at any time

9. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not upload content that infringes on others' intellectual property rights
• Not attempt to gain unauthorized access to the Service or other users' accounts
• Not use the Service to distribute malware or harmful code
• Comply with all applicable laws and regulations

10. Service Availability

• We strive to maintain high service availability but do not guarantee 100% uptime
• We may perform maintenance that temporarily affects service availability
• We will provide reasonable notice of scheduled maintenance when possible

11. Limitation of Liability

11.1 AS IS Disclaimer THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2 Limitation of Liability To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
• We are not responsible for any content you create, upload, or distribute using the Service

12. Termination

12.1 By You

• You may terminate your account at any time
• Upon termination, you may export your content before account deletion

12.2 By Us

• We may suspend or terminate your account for violation of these Terms
• We will provide reasonable notice and opportunity to cure violations when possible
• We may terminate accounts that remain inactive for extended periods

13. Changes to Terms

• We may update these Terms from time to time
• We will notify you of material changes via email or through the Service
• Continued use of the Service after changes constitutes acceptance of the new Terms

14. Governing Law and Disputes

• These Terms are governed by the laws of the Netherlands
• Any disputes shall be resolved in the courts of the Netherlands
• We encourage users to contact us directly to resolve any issues before pursuing legal action
